Utilizing its âOne Country, Two Systemsâ principle and legal system as leverage points for infrastructure investments, financing, Fintech developments and Fintech businesses which create an ideal platform for data convergence to make Hong Kong an information hub globally. At the same time it must protect personal information while guaranteeing cross-border flows conform to national management framework.
Under the Personal Data (Privacy) Ordinance, personal data may only be collected lawfully for lawful purposes and in an amount sufficient for its intended use. Furthermore, data users must be transparent regarding why they collect personal data and obtain consent before using it for direct marketing purposes; investigations and prosecution related to direct marketing remain a top enforcement priority of the Privacy Commissioner.
ITIB released its Policy Statement on Facilitating Data Flow Within the Greater Bay Area in June 2023 in order to facilitate cross-boundary data flow between Hong Kong and Mainland and strengthen GBA standard contract compliance arrangements, encouraging enterprises to collaborate for innovative and collaborative digital developments between these two regions.
